Criminal "Justice" Demanding Certainty in an Uncertain World by Cullen Couch “The criminal justice system is characterized by extraordinary discretion—over the definition of crimes (legislatures can criminalize as much as they wish), over enforcement (police and prosecutors can arrest and charge whom they wish), and over funding. Certainty is perfect knowledge that has total security from error, or the mental state of being without doubt. Objectively defined, certainty is total continuity and validity of all foundational inquiry, to the highest degree of precision. Something is certain only if no skepticism can occur.
Therefore this seems to prove that the UK’s adherence to contract certainty far outweighs the basic principles of justice, which leads one to believe that notion of utmost good faith is an exception to the rule of upholding the certainty of contract, especially in respect to contracts that are made by companies.
